Proclamation of the Constitution of the Republic of Kurdistan
The first text of the Constitution and the foundation of the constitutional, legal and political system of the Republic of Kurdistan.
The Kurdish nation, as a mother nation, is the authentic owner and inheritor of those constitutive historical and civilizational realities that have sprung from the depths of the history of Sumer, Mitanni, Hurrians, Gutians, and others, and that reached the summit of the unifying reason of statecraft in Media and the Sassanid era. This reason of statecraft exercised sovereignty across the entire national territory of Kurdistan and asserted its own existence. This existence, whose roots were planted in the ancient cultures of the Caucasus, Zagros, Alborz, and Taurus, was not merely a geographical connection, but the very same historical self-asserting existence that carried civilization from the mountains to the cities and city-states of the surrounding plains, and founded it upon its absolute sovereignty and its thousands-of-years-old law.
Over the past centuries, and now after passing through the stage of subjugation and the sufferings of genocide and every unforgivable crime, relying upon public reason, collective wisdom, and the manifest will that was formally expressed in the 2017 referendum in the south of the homeland; by the raising of voices in the subjugated parts, in the form of taking to the streets in support of the vote for independence in the south of the country; and, most recently, by the raising of the voice of independence in the demonstrations of hundreds of thousands in January 2026, with slogans of homeland protection and state-seeking and by raising the sacred flag of Kurdistan, we hereby proclaim the perennial will of the Kurds through this Constitution.
The Republic of Kurdistan, which was proclaimed in Mahabad in 1946 as an absolute national will, has remained perennial in meaning and legitimacy. Although the occupiers physically dissolved the Republic and forced the Kurdish nation into a prolonged condition of deconstruction, this Constitution, as the highest existential demand, brings an end to that condition and to the murky current of deconstruction and statelessness, and refounds the historical meaning of the Republic as a reality of sovereignty. Through this, we transform ourselves into an active, history-making subject within the very depths of our own country, where every Kurd is a citizen of Kurdistan and all Kurds are citizens of the Republic of Kurdistan.
This Declaration is the decisive beginning of the legitimacy and self-referential constitutional authority of the Republic of Kurdistan. In this sense, it is the first institution of the State of Kurdistan, established as a sacred and necessary instrument and as the field and environment of homeland politics for fulfilling the essential will of the Kurdish nation in the country of Kurdistan. It does not, in any way, derive its legitimacy from outside the covenant between the Kurds and their own national territory.
The republican form of the State of Kurdistan, as a present foundational principle and as the absolute rejection of every form of dynastic or personalist power, is the highest achievement of the struggle, collective awareness, and national self-consciousness that resounds in this Constitution. The supreme aim of the State of Kurdistan within this Constitution is both to provide public service to the society of Kurdistan and to establish absolute sovereignty over the national territory of Kurdistan, to guarantee the dignified survival of Kurdistan, and to protect unconditionally the highest national interests above every temporary partisan or group interest.
Within the structure of power, the foundational skeleton of statecraft establishes the essential separation of powers. The judiciary possesses absolute fundamental independence, guaranteed through an independent budget and independent administration, so that it may become the impartial conscience of the Republic and the guardian of the sovereignty of law over all.
The National Parliament and the Senate shall function as the echo of the collective wisdom of Kurdistan. Through the oversight of the National Parliament over the executive authority, they shall prevent every form of insubordination and deviation from the process of legislation.
Kurdistani citizenship, as Peshmerga citizenship, carries the highest national duty to defend the sanctity of the soil and to fulfill national service. In the sphere of security, the doctrine of active defense and preemptive protection, through national intelligence and the National Center for Intelligence and Strategic Analysis, shall neutralize threats before they reach the national territory.
The National Defense Force / Army, as the steel sword of the country, shall be bound only to the national flag of Kurdistan and to the Constitution. Partisan or regional loyalty within this force shall be considered a crime that subverts the foundations of the state.
In the economic dimension, the national economy shall be founded upon the economy of the State of Kurdistan, national capitalism, and a multi-foundational economy. Natural resources shall be treated as a sacred trust for future generations, and their management, through the High Council for the National Economy, shall aim at sustainable development and at preventing the internal financial hemorrhaging of Kurdistan’s wealth.
Confronting corruption, the crime of kleptocracy, and the decay of the state, which are defined as poison within the body of the state, is an existential duty for protecting public trust and for establishing meritocracy, transparency, and clarity within the institutions of the State of Kurdistan.
The intelligent state and the system of the intelligent state, through a strict legal and ethical framework for technology, shall guarantee the technological and digital sovereignty of Kurdistan. This modern dimension shall protect the national digital identity of citizens against every form of algorithmic intrusion and every violation of the protection of personal data and digital privacy.
Finally, this Constitution, as the existential self-asserting doctrine of Kurdistanism, balances Kurdishness — as ontological and historical authenticity — with Kurdistani-ness — as homeland protection, legal citizenship, and inclusive equality. The official status of the Kurdish language shall hold the highest position, while the rights and dignity of the cultural and linguistic identities of non-Kurds shall be protected within the framework of unconditional loyalty to the state and to the unity of the national territory.
This text is the covenant between the generations of the past, the present, and the future, and it is the absolute rejection of every form of national treason and submission to foreigners. For the Kurdish nation has decided that it shall no longer remain in the dark chamber of modern history, but shall instead, as a sovereign subject possessing its own will, assert national dignity through action.
Through this Constitution, the Kurdish nation proclaims its own Constitution. This document is not merely a covenant of homeland politics, but a rational guide for state-building and statecraft, and a practical roadmap for the politics of Kurdistan, the methodology of institution-building, and intelligent governance.
Here, the eternal and perennial will of the Kurds shall remain the guardian of dignified survival and the everlasting source of the sovereignty of the Republic of Kurdistan.
Long live the Republic of Kurdistan,
the land of state reason and the fortress of the sovereignty of the Kurdish nation.
